Rent Review Notice: How to Serve a Valid Increase

A rent increase is only valid if served correctly. Get the notice wrong and the increase is void — your tenant can challenge it at the RTB and win. Here’s the template, the requirements, and the mistakes that invalidate a review.

Legal Requirements

  • 90 days’ notice before the new rent takes effect
  • Written notice in the prescribed format
  • Must state: current rent, new rent, date new rent takes effect, date of last rent review, and details of 3 comparable properties (if in an RPZ)
  • Must confirm that the tenancy is registered with the RTB
  • Must not exceed the RPZ cap (if applicable) or market rate (if non-RPZ)

A valid rent review notice should contain: your name and address as landlord, the tenant’s name and the property address, the current rent amount, the proposed new rent amount, the date from which the new rent applies (minimum 90 days from the date of the notice), the date of the most recent previous rent review (or the commencement of the tenancy if no previous review), the signature of the landlord or their agent, and a statement that the tenancy is registered with the RTB.

RPZ additional requirement: You must include details of 3 comparable properties in the area with similar rents. These must be genuine, verifiable comparables — not fabricated. The RTB can and does check.
